What this policy is
This policy explains how Health-e Enterprises, LLC (“Healing Gourmet,” “we,” “us”) handles consumer health data — information that identifies your past, present or future physical or mental health status.
It is separate from our general Privacy Policy and applies specifically to health information. Where the two differ regarding health data, this policy governs. It is written to meet the requirements of Washington’s My Health My Data Act, Nevada’s consumer health data law, and comparable provisions in other state privacy laws, and we apply it to everyone regardless of where they live.
What we are not. Healing Gourmet is a nutrition education and food company. We are not a healthcare provider, a health plan, or a healthcare clearinghouse, and we are not a business associate of one. We do not diagnose, treat or provide medical care, and we are not a HIPAA covered entity. Information you share with us is not protected health information under HIPAA, which is part of why this policy exists.
The health data we collect
We only collect health information that you choose to give us. We do not purchase health data, and we do not infer health conditions from your browsing behavior.
From the Diet Decode™ quiz
Symptoms and experiences you report — energy levels, digestive symptoms, hunger and appetite patterns, sleep, and how you respond to particular foods. Your responses to questions about your goals and current way of eating. Which assessment track your answers correspond to.
From the Concierge Nutrition Intelligence™ application
Because this is an application for a personalized program, it asks for more: what you are currently experiencing and for how long, practitioners you have consulted, approaches you have already tried, medications and supplements if you choose to mention them, how much your situation affects daily life, and anything else you decide to tell us. If you are accepted into the program, we also receive whatever you share during the engagement, which may include laboratory results, diagnoses and clinical information you choose to provide.
From email replies and correspondence
Our emails invite replies, and people frequently describe their health circumstances in them. Anything you write to us becomes information we hold.
From purchases and subscriptions
What you buy can imply a dietary need or health interest. We treat purchase information that reveals a health condition as health data.
What we do not collect
We do not collect precise geolocation. We do not use biometric identifiers. We do not scrape health information from other sources, buy it from data brokers, or combine your information with purchased third-party datasets to build a health profile.
Where it comes from
All consumer health data we hold comes from one of three places: directly from you, through a form, a quiz, an email or a conversation; from your transactions with us, where a purchase implies a dietary or health need; or from your interactions with our emails and website, limited to which of our own messages and pages you engage with.
We do not obtain consumer health data from data brokers, advertising networks, public records or any other third-party source.
Why we collect it
To answer the question you asked us. Diet Decode responses are used to generate your results and to send you the educational sequence matched to what you described.
To evaluate applications. Concierge application responses are used to decide whether the program is a fit for you and, if you are accepted, to build your program.
To deliver what you have purchased or signed up for, including personalized guidance within Concierge.
To improve our educational content, in aggregate. When we notice that many readers describe a similar problem, we write about it. This use is aggregated and does not identify you.
To respond when you write to us.
We do not use consumer health data for targeted advertising. We do not use it to build advertising audiences, and we do not provide it to advertising platforms.
Automated processing
Some of what we do uses automated systems, and you should know where.
Diet Decode™ uses automated logic to sort your responses into patterns and route you to the matching educational material. It is pattern matching against the answers you gave. It does not diagnose anything, it does not access your medical records, and it produces educational content rather than a clinical assessment.
Meal Genius® uses automated systems to generate meal plans and recipe recommendations from the preferences, restrictions and goals you provide.
We use AI tools to help produce written content. Drafting, research assistance and editing. Everything published under Kelley Herring’s name is reviewed by her before it goes out, and every health-related claim is checked against sources by a person.
Concierge Nutrition Intelligence™ is delivered by a person. AI tools may assist with analysis and drafting, but the protocol is built and reviewed by Kelley Herring. You are not receiving machine-generated guidance.
No solely automated decisions with significant effects. We do not use automated processing alone to make decisions that produce legal or similarly significant effects about you. Your health data is not used to train AI models. We do not submit your health information to third-party AI systems for model training, and we do not permit our vendors to use it for that purpose.
